Vitalimage Inc., ("Vitalimage," "we," "us" or "our") provides this privacy policy ("Privacy Policy") in order to make you aware of the privacy practices at our Website that posts this Privacy Policy (the "Website"), and of the choices you can make about the way your information is collected and used by Vitalimage. This Privacy Policy only covers information collected at the Website, and does not cover any information collected at any other web site or offline by Vitalimage (unless specifically stated).

Note, too, that there may be times where Vitalimage jointly collects your information with another party on a co-branded web site. In those cases, if this Privacy Policy is posted, it may only apply to how Vitalimage uses the information it collects through that co-branded web site, but the privacy policy of the other party may govern with regard to the use of technology or operation of the co-branded web site and its use of information collected on such co-branded web site.

You can browse our Websites without telling us who you are or revealing any Personal Information (as defined in Section 1 below) about yourself.  However, once you choose to give us your Personal Information, you are then no longer anonymous to us.  If you choose to provide us with Personal Information, you consent to the transfer and storage of that information by us on our servers located in the United States.

1. What information may Vitalimage collect and store?

Through its Website, Vitalimage may collect and store "Personally Identifiable Information" which is any information that can be used to specifically identify an individual, such as your name, mailing address, e-mail address, telephone number, and sometimes financial information, such as credit card or bank account numbers (however, if your purchase is completed through a third party payment processor such as PayPal then that financial information is disclosed by and through you and a third party payment processor on a third party site that we do not have visibility or access to and in such case we do not have or maintain any such financial information of yours).  From to time, users of our Website may elect to  provide us with Personally Identifiable Information and certain demographic information (such as email address, zip code, hometown or similar information) through Web Site features that we may  potentially implement or that may be in effect from time to time, including, information related to your completion or submission of surveys, online registration forms, sweepstakes entries and promotions; and/or email address, phone number, physical contact information; shipping, billing, advertising and other information you provide to purchase or ship an item; other information from your interaction with our Website, including device ID, computer and connection information; and information related to sign up for, or redeem, special offers; information pertaining to respond to surveys, sweepstakes or other promotions.  Additionally, when you visit our Website our servers may automatically collect certain information from you, such as statistics on page views and pages accessed, browser type and IP address, navigational data including traffic to and from the sites, ad data, and standard web log information. Most of this information is non-personally identifiable information, but if we connect it or demographic information with Personally Identifiable Information, we will treat it as Personally Identifiable Information.

2. What technologies does Vitalimage use?

We use a variety of technologies on our Website including cookies, web beacons and javascript. Cookies are small data files that are transferred to your computer (or other Internet-accessing device) when you visit the Website. Cookies allow us to improve and enhance the Web Site and serve users more appropriate content. Most browsers are initially set up to accept cookies but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent by indicating this in the preferences or options menu in your browser. However, it is possible that some parts of the Website will not operate correctly if you disable cookies and you may not be able to take advantage of some of this Website's features. You should consult with your browser's provider/manufacturer if you have any questions regarding disabling cookies.

The Website and any communications sent by the Website may contain electronic images (generally, single-pixel ".gif" images) called "web beacons." These web beacons allow Vitalimage and third parties to monitor and collect certain information about the viewer of the web page, web-based document, e-mail message or other communication, such as the type of browser requesting the web beacon and the time the web beacon was viewed. We may use web beacons or similar technologies for a number of purposes, such as and without limitation, to count visitors to our web pages or to monitor how our users navigate this Website and to count how many e-mails (or particular articles, links, etc.) we sent were actually opened.

The Website may also utilize embedded scripts which is programming code that is designed to collect information about your interactions with the Website. The script is temporarily downloaded onto your computer from our web server or a third party service provider, is active only while you are connected to the Website, and is deleted thereafter.

3. How is the information used by Vitalimage?

The information Vitalimage collects may be used by us, at our discretion, from time to time to:

  • fulfill your requests and orders for our products and services and/or complete a transaction you have requested;
  • communicate with you about the status of your orders and other inquiries about our products and services;
  • send you information about our products and services;
  • for our internal business purposes, such as data analysis, audits and so forth;
  • help us create content that is most relevant to you;
  • improve the content of the Website;
  • notify you about updates to our Website and in our discretion, changes to this Privacy Policy, our Terms of Use and other policies that affect your use of the Website;
  • contact customers for customer service, and/or product quality issues;
  • administer and provide you with information and updates regarding any customer loyalty, promotions, and rewards programs;
  • send you e-mail communications or otherwise contact you regarding any job search if we post any employment opportunities that we may have open;

Content (digital pictures/photographs) you submit:

Users of our Website will upload their digital pictures/photographs to create a custom poster.  We will not retain a copy of any such digital pictures/photographs either when you exit the site and close the browser window if you choose not to complete an order, or after the order is completed, and we will never sell your pictures/photographs or share your pictures/photographs with any third party without your consent.  Further information regarding use of the Website is set forth in our Terms of Use.

Affiliate information:

At our discretion, Vitalimage may offer an affiliate program for qualified websites. Participation is optional and based on Vitalimage approval. Application information is used to determine eligibility in the Vitalimage affiliate program. Account information of approved affiliates is maintained for the purposes of communication between Vitalimage and its affiliates.

Information from third parties:

We may receive information about you from other sources; for example, we may obtain geographic or demographic information, or information regarding your possible interests, from third parties, or we may receive information from a marketing partner in connection with a co-branded web site or promotion. We may use this information for a variety of purposes, including to enhance our ability to serve you and to tailor content. We may combine the information we receive from those other sources with information we collect through the Website. In those cases, we will apply this Privacy Policy to any Personally Identifiable Information received, unless otherwise specifically disclosed by us at the time you provide your Personally Identifiable Information.

Send to a friend:

If we implement the functionality for you to be able to send a friend a communication from the Website, the information you provide (names, e-mail addresses, phone numbers, etc.) is used on a one-time basis to facilitate the communication and is not used for any other marketing purpose, unless we obtain additional consent.

4. How is information shared with third parties?

We may share non-personally identifiable information and other web site usage information with our business partners and third parties. In addition, we may share Personally Identifiable Information as disclosed at the time you provide your information, as set forth in this Privacy Policy and in the following circumstances:

Marketing:

We will NOT sell or rent your personal information to third parties for their marketing purposes without your explicit consent.  We may combine your information with information we collect from other companies and use it to improve and personalize our services, content and advertising.  If you don't wish to receive marketing communications from us or participate in our ad-customization programs, simply indicate your preference by following the directions provided with any communication or advertisement we might offer from time to time.

Third parties providing services:

We may employ third parties to perform functions on our behalf, for example, hosting or operating the Website, fulfilling orders for products and services purchased through the Website, sending e-mail and/or other communications, data analysis, marketing assistance, credit card payment processing, and customer service. These third parties may have access to your Personally Identifiable Information for the purpose of performing such functions on Vitalimage's behalf.

Corporate change:

Vitalimage may share the Personally Identifiable Information collected through the Website with and among its parent, subsidiaries and affiliates. Vitalimage or any of its assets, including the Website, may be sold, or other transactions may occur in which your Personally Identifiable Information is one of the key business assets for the transaction. In such a case, your Personally Identifiable Information may be one of the business assets we transfer. Hence, Vitalimage reserves the right to disclose and transfer Personally Identifiable Information in connection with a corporate merger, consolidation, restructuring, the sale of substantially all of our assets, or other corporate change.

Legal actions and law enforcement:

We may disclose your Personally Identifiable Information, in the event we are required to respond to subpoenas, court orders, legal process or other valid law enforcement measures; to comply with a legal obligation; at the request of governmental authorities conducting an investigation; to verify or enforce compliance with the policies governing the Website and applicable laws; or to protect the legal rights, interests, or safety of the Website, our users or others. We may also use information collected on our Website to identify users, and may do so in cooperation with copyright owners, internet service providers, wireless service providers or law enforcement agencies in our discretion. Security:

Our Website takes commercially reasonable steps to secure the information you provide. However, no data transmission over the Internet, or wireless transmission, or electronic storage of information can be guaranteed to be 100% secure. Therefore, please know that any information you transmit to or through our Website or third party website affiliated with the Company’s Website you do at your own risk.  Further, Vitalimage does not receive or store credit card information of our users as all payment at checkout is processed through the third party payment processer (i.e. PayPal).

Links to third party Website:

The Website may provide links to partner, affiliate, and/or advertiser sites for additional information on their products and services. We are not responsible for the privacy practices or content of any third party Website and do not make any representations regarding how such websites use customer information.

Consent to transfer:

The Website is operated in the United States. If you are located in the European Union, Canada or elsewhere outside of the United States, please be aware that any information you provide to us will be processed in and transferred to the United States. By using the Website or providing us with your information, you consent to this transfer and to the processing and storage of your information in the United States, a jurisdiction in which the privacy laws may not be as comprehensive as those in the country where you reside and/or are a citizen.

A note for parents:

The Website is a general audience Website. We do not knowingly collect any Personally Identifiable Information from children younger than the age of thirteen (13) on the Website and we will delete any Personally Identifiable Information later determined to be from a user younger than thirteen (13).  If you are under the age of 13, please do not submit any Personal Information to us, and rely on a parent or guardian to assist you. Children under the age of 13 are allowed to upload photographs and to order products only with their parent's or guardian’s consent and assistance.

California Privacy Rights:

Pursuant to Section 1798.83 of the California Civil Code, residents of California have the right to request from a business, with whom the California resident has an established business relationship, certain information with respect to the types of personal information the business shares with third parties for direct marketing purposes by such third party and the identities of the third parties with whom the business has shared such information during the immediately preceding calendar year.

5. How might this Privacy Policy change in the future?

If our information practices change at some time in the future, we will post the revised privacy policy on the Website with an updated "Effective Date" to notify you of these changes. If there are material changes to this Privacy Policy or in how Vitalimage will use your Personally Identifiable Information, we will notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to periodically review this Privacy Policy to be informed of how Vitalimage is protecting your information.

6. How can I access or change my Personally Identifiable Information?

Currently we do not retain or store your Personally Identifiable Information on the Website but in the event we ever do change our processes and procedure and retain or store Personally Identifiable Information in the future then we will offer you the ability to review, correct and/or update the same.
